Usually any hit from behind would be "their" fault but this one seems to be to be a both-fault or no-fault accident. Sorry to say, but you are at majority fault. The idea here is that the car that hit you was travelling a straight path in an proper lane of traffic. Technically, you are not considered to be in a travel lane if you are pulling off of the curb, driveway, or the like. If it was not for you, the car could have continued without incident.
