it was parked next to my apt. my neighbor was backing up and hit it. She saw the car there as she needs to pass in front of it to get to her garage. my car was not blocking any passageway and only an idiot not paying attention while backing up could hit it. am I any at fault?

since i wasn't there i can only go by what you have told us,,but if you was not parked legal,,she can hold you at fault especially if you was in any way blocking her drive way ..the laws sometimes aren't too fair on these matters,,but they do plainly state if you are blocking someones drive way ,and they hit you ,there not at fault,,so on this one i don't know,if you got a ticket for it this makes you legally at fault,but it doesn't mean its right,just do the best you can with the situation,,that's all anyone could do,,good luck,i hope this help,sWhat are your favourite super cars?
For most states the way it works is the car that was moving is at fault for the accident. The officer who shows up to the accident to write a report can ticket the other car for being parked illegally but parking that way doesn't justify the other driver's fender bender. For instance I was driving and went around a bend in the road and hit a car parked illegally. I was at fault for the accident and she was cited for her parking. I'm sure the insurance company will consider you partially at fault.It happens all the time. Some companies try to get the innocent parties co. to pay 10% just for being on the road. No kidding. You'll have to pay some if parked illegally. I'd bet on it.
