Who's at fault? backed into an illegally parked car...?

I live in a 5 unit apt. complex, with 5 car-car port, and I backed into the second car of my neighbor whom continues to park behind my carport illegally. They were instructed by the building owner and manager not to park their car there.
Last week i backed into the parked car, and damaged the fender and damages came to $1,000. After talking to the boyfriend of the damaged car- he feels I am 100% liable for the damages, and feels I must pay the $1,000. I felt 50/50 it is a more reasonable arrangement. But, he will not accept 50 fault and will not fork out half of the money- how to handle this situation?

Unfortunately, it might not seem fair, but you are at fault. You were in control of your car, and you backed into their car. It doesn't really matter where they were parked. Pay up, and if they park behind your carport again, call the manager and tell them to have the car towed.

I'm not an insureance major, but i do believe it would be 50/50. If you have any questions call an insurance company, do not give your name and do not call your own company, but ask the question of who is at fault. and if it turns out its 50/50 or his fault take him to court.

50/50 sounds reasonable if you are not going to use the insurance co.If they refuse your offer, small claims court for the full amount, but expect $500. After that if they keep parking there, call the cops and have them tow it away, that should stop them when they have to pay to get the car back.

You ran into a parked car. Illegally parked or not its still a parked car. Sounds like you thought you could back around it or through a space too small to fit your car through. next time you come out to find his/her car parked in the way of you're being able to get in or out, call the manager and have the car towed, or call the local towing service yourself. I know it sound mean, but if they haven;t gotten the message yet, well??. It's kinda hard to have the cops come in and cite him, because for the most part, the incident happened on private party, and if there are no injuries invloved, they tend to stay away and let you handle it between the two of you. otherwise, HE NEVER SHOULDA PARKED THERE, the dummy. He's lucky you're honest enough to admit to hitting his car.
