It really depends on what state you are in. Each state has different laws on how and when mechanic's liens are formed, and what happens with an abandoned auto. In Maryland, a mechanic's lien is automatically formed when you do repairs to a vehicle, that lien is primary over any other lien or claim. In other words the mechanic must be paid. If the repair bill isn't paid you can exercise the mechanics lien and take title to the vehicle. Its a lengthy process that must be done thru the department of motor vehicles. Locally we have a company that handles the paper work, we pay them a flat fee and they get us a clear title. They are normally called "lein and recovery companies" i.e. Nationwide Lien and Recovery, or Allstate Lien & Recovery. You could probably search the internet / yellow pages for a similar company in your local. The cost is about $200-300 plus DMV costs. But atleast in our area its better to pay them to do it instead of trying to jump thru all the governmental hoops. For one, the car has to be auctioned in our state, so that you don't get a $20k car for a $100 repair. You only get the cost of your repair and storage, and the remainder has to go to the owner of the vehicle/estate in your case. But if no one bids enough on the car to cover what you are owed then the car is yours. Obviously you need to find out the deal in your state, but I'm sure if you repost with the state you live in someone could get you an answer.No you will have to seek legal advise

Yes..You need to find out from the family or find out if she had a lawyer and had a will.And or get in touch with the title bureau.in your state and get a new title from the state.Get a hold of family if you have there address and you can say that the lean on this car is what ever price it is. and see if you can get your money or just say it was abanded and go to the state title bureau.
