Question:
Is a smog certificate required for trading in a car to a dealer in California when purchasing a new car?
If the dealer accepts the trade-in, can he later cancel it on the grounds that the car does not have the smog certificate?
What kind of a car should I buy?
Thanks.

No.I have a '91 Z/28, 5.7L TPI. Should I trade it in on a new 2009?
your best bet would be calling a couple of dealers to see or the dmvWell the law states that the seller of a vehicle is responsible for a smog certificate..which gets me to thinking why does the dealer make you pay for it? Damn them.
A dealer will take the trade in without a smog. They buy your car cheap and have a shop. Unless you have made some kind of illegal changes in the smog system you should not have a problem.. I have traded more cars in California than you would believe.. Life is short get what you want.
If you're selling it to a private party you MUST smog it. If you trade it in to a dealer you don't have to. More than likely the dealer will sell your car at auction anyway and some totally different dealer will mess with smogging it. Or, if the car is bad enough it may go straight to a wrecking yard or an auction like CoPart which mostly sells to wrecking yards.
