49cc gas motor scooters?

Hi, I'm looking at some scooters on the internet and they are 49cc gas motor scooters. They are NOT mopeds. I heard from a friend that they are street legal if they are under 49cc. He said it varies in different states. Oh yea, I live in maryland and I am 12 years old so my dad needs proof before he lets me get one. Please help THANKS!

(a) In general.- "Motor scooter" means a nonpedal vehicle that:
(1) Has a seat for the operator;
(2) Has two wheels, of which one is 10 inches or more in diameter;
(3) Has a step-through chassis;
(4) Has a motor:
(i) With a rating of 2.7 brake horsepower or less; or
(ii) If the motor is an internal combustion engine, with a capacity of 50 cubic centimeters piston displacement or less; and
(5) Is equipped with an automatic transmission.

16-104.2. Moped operator's permit.

(2) When issued and signed, a moped operator's permit only authorizes its holder to operate a moped, as defined in § 11-134.1 of this article or a motor scooter, as defined in § 11-134.5 of this article.
(e) Expiration and renewal.- A moped operator's permit expires every 5 years. It may be renewed on application and payment of the fee required by subsection (f) of this section.
(f) Fee.-
(1) For issuance or renewal of a moped operator's permit, an applicant shall pay the Administration a fee established by the Administration.
(2) For issuance of a duplicate moped operator's permit, an applicant shall pay the Administration a fee established by the Administration.
