Most of the time it is the buyers responsibility. But if you sell the car "AS IS" and they sign an agreement that you write up or pay you with the agreement signed then they have given up the right to pas smog and it is now their problem. That is if they know about it. If they didnt know it is a different story. Hope that helps.
