Question:
I've recently purchased a new car (Toyota FJ Cruiser) and I have no need for my old car, a 95 Hona Civic.
There's a guy at work who wants to buy it from me for $500 - it's really beat up and has almost 200,000 miles on it. He knows that it's old, beat up, and runs like any old, used car - just OK. Well, I recently found out that this guy has had SEVERAL tickets for speeding, running red lights, and causing accidents. Every one of these tickets he's tryed to take to court. He's also attempted several law suits for diffrent things. So, this being said - what if the car breaks down after he buys it? I'm afraid he's going to try and make me take care of it . Or worse, sue me!
What kind of work enviornment will that be?
Am I better off not selling?
Are there any kind of solid contracts I can download from the internet so insure the car's being sold "as is" and nothing is my responsibility?
Anyone ever delt with this before?
Answers:
Can you get a one year lease on a new vehicle? Or is 2 year the minimum?
it sounds like a $500.00 car so if you sell it to him hes getting what he pays for. if you sell it to him make sure you get him to sign a bill of sell, this will protect you if he gets into any trouble in the car and does not register it in his name. as for him having a problem with the car and wanting to sue you, the law is on your side, as an individual you do not have to warranty a car you sell, for that matter niether would a dealer on any used car, you've heard of "buyer beware"? if you want to feel better just add a no warranty clause to the bill of sell. this does not have to be any formal contract or bill of sell, you can just write one up on the computer. date of sell, seller, buyer, year, make, model, color, license plate, vin, mileage and any special agreement as to the sell should be included in this document. have it witnessed at least or notorized if possible. Why doesn't my 1934 5th hand mercedes work when i bought it?
If he knows the condition of the car, he can't have false and exaggerated expectations. Besides, he can't expect too much from a car he paid $500 for. If you feel it will create static in the workplace, then don't do it. Go with your gut feeling.Where is the lowest sales tax in colorado (for buying a car)?
you may write out a sales agreement stating that you are selling the car "as is" with no warranty expressed or implied. He signs, you sign and date. Make a copy for each of you.
