but the problem is that the cylinder number 2 is up i notice this by placing a screwdriver thru the spark plug holes and i am using a hei high electric ignition coil distributor not points.
so what should i do ? or can i drop it like that in the car?

On SBC #1 & #2 are on a common crankpin,,therefore both are at TDC simultaneously.Ignore #2 and verify that #1 is on Compression Stroke.

1/8" shorter stroke than a 400 Small Block,or a 396 Big Block,,or that 400 Big Block thing they made a while back.
Should be a "Fun 400" 393",,,rev a bit quicker than the 3.75 " stroke motors.

you take the spark plugs all out...put finger in number 1 hole and have someone turn the engine clockwise until it comes up on compression. Align the mark on the damper with the zero mark on the timing tab. Now you install the distributor with the rotor facing towards the number 1 sparkplug tower on the distributor cap. By the way its a 396 not 393
Any Information on the Mercedes-Benz 400SL?
I own a shop, and can tell you this; If it is still on the engine stand, remove the valve cover, turn the engine over until the timing marks align at zero, and both valves on the number 1 cylinder are closed with the springs in the relaxed position. Drop the distributor in so the rotor button points to the #1 plug wire on the cap with the distributor all the way down. You may have to use a long screwdriver to turn the oil pump to where the distributor will go all the way down. I have found it is best to tape up the distributor hole, and leave the distributor out until the engine is in place. This way you don't risk damaging it when you install the engine. Also; it's a good idea to use a drill motor, and a long screwdriver (with the handle broke off) for a method of priming the oiling system before you start the engine. This way it won't be started up completely dry, as this is bad on an engine to do so. An engine that has been sitting, will have no oil in the upper section, or in the bearings. Once you prime it for a few minutes to get oil pressure up, then install the distributor, and start it up.Glad to help out, Good Luck!
