I was charged with a dwi to boot. The insurance company has got the total up to around 19,000.00. so im asuming this will definatly grow.
Can someone tell me what this means?
details, the person i hit left the scene of the crime. As he was probably drinking too. and secondly i have pictures proving his car is fine even though his insurance agency has called it totalled....so basically am i screwed? or is it worth dishing out another 5k to fight. being that ive dished out about 5k so far for my d.w.i.

I take it law enforcement showed up at the scene? If so, how was the guy you hit able to put a claim on his insurance, if he left the scene? Did law enforcement arrest him for leaving the scene of an accident? If you have proof that his car is not damaged, I would fight the insurance company. There are lots of things going on here, and that other driver is holding some of the info. I don't understand how his insurance is going to file suit, or cover his damages if he left the scene, it doesn't make sense. A car can be considered "totalled" if it has incurred more damages then the car is worth, with unibody construction on newer cars, it doesn't take much of a hit to total them, as they are formed in one huge mold, instead of separate sections like older cars were made, and the separate sections could be removed and replaced. That attorney you have for the DWI, isn't he helping you on this case? It should be included, as it was the reason you got caught drinking, I would press him for some info. I don't think you are screwed, I think the guy you hit has something to hide, and you need to press forward to protect yourself. Get back with the attorney and work it out. By the way, I am hopeful that drunk driving is something in your past, it affects many people when an accident occurs, sometimes fatally, and it's usually the innocent victim that is injured. My ex had a problem with alcohol, we spent thousands on wrecks, DWI's, and a divorce. I hope this experience may have opened your eyes a bit on this subject, how would you have felt if you had killed someone in that wreck? I don't want to preach, just want to say that, you can make things change in your life, realizing that alcohol is causing you legal problems, and possibly relationships is the first step. First off, when did the insurance expire exactly? You do know you get a 10 day grace period before they can even 'attempt' to cancel it, and then another ten days before they completely terminate the policy.

Ask them the exact dates and get it in writing or print-out. Get this without explaining the whole situation to them first. They'll be more apt to get you the info you need.

No insurance? Drinking? You rear-ended another car? The other guy left the scene? You have BOTH screwed yourselves, except you have done it twice as bad as him. He at least has insurance, and your details as well. And your pictures may show little damage from that angle, but an adjuster would look a lot closer than your cell-phone snap.
