I got a very sophisticated situation here. On 1/30/07, I got into a car accident and the other driver was at fault, but it took for the other driver's insurance company almost for a month to send me a check. Within a month, I got into another car accident, and this time I got struck from the behind again at the same spot. I already have received a check from the first insurance company, but I am still working on the issue with second insurance company. What should I do to resolve this doomed situation? The car is not yet fixed.

If the car had been fixed, this would be simple. Now you have to try and justify what is existing damage and what is new, because to accept payment for anything twice is fraud. Well, if the first accident ONLY hit the bumper and they are paying to replace the bumper.. you are not owed another check to replace the bumper. You should probably show the second insurance company the first companies estimate- so they know which damage is new.

Of course.. you could not tell them about the first accident and get a second check for the damage. but you are facing a big risk here b/c if they find out its fraud and you can be charged.. and they have access to your accident records.

If you broke a leg and received payment for that and in the second accident the same leg was broken would you say no thanks it was already paid for? I'd take what you are offered from both companies. I take it you were rearended in the first accident as well as the second, correct? Do you have photos showing the damage from the first wreck, or a report from someone who looked it over for your insurance company? You are going to have to show that more damage occurred, from the second wreck. I also am wondering how old your car is, and if it was insurance destroyed/totalled by the first wreck, if it was and you haven't gotten the repairs made and an inspection done for the retitling of the car, legally you shouldn't have been driving the car, it should have been garaged and getting fixed. If that's what's going on, you will not receive reimbursement for the second wreck, and you could be ticketed for driving an unsafe vehicle.What do I need to get temporary plates in Michigan?
For starters .. stay the H*** away from that spot! Hot D*** that spot is unlucky for you!Hit once there .. take a look at what you could have done to avoid further occurances! Hit twice at the SAME spot? Avoid a third trip there!
