I was In the intersection waiting to make a left turn when the light turns yellow. I start turning and then I think the light went red and I see this guy comming straight at me. He hits my car and then we both pull up to a Mcdonalds parking lot to check the damage. My car door is now caved in and theres a huge dent in it. All the other guy got was a scratch on his paint job. The dude has no license, was drinving his brothers car who has insurance and I think he might have also been an illegal imigrant. The cops came, arrested him and gave me this form with the other guys insurance info.
I was awarded restitution, how can I collect before he pays?
I really dont want my insurance to go up. Is there anything I can do so that my insurance wont go up? If you were in the intersection before the light turned yellow you need to clear the intersection for oncoming traffic, perfectly legal. If the guy that hit you had no license than it shouldn't be your fault. Explain what happened to your insurance company and make SURE they know the other guy had no license. Whenever a driver is turning left in front of oncoming traffic it is their duty to yield right of way to oncoming traffic. In addition, you flat out admit your light turned red while you were turning. At best, you will only be found partially at fault. The fact that the other driver does not have a license absolutely plays no role in this. That has nothing to do with whos at fault in an accident. The other driver having no license is not a "get out of jail free card"
