Question:
I did not realize that I was supposed to provide proof of current smog certification. I have always had smog checks when required by the DMV. I sold my car, and the buyers neglected to ask for current smog certification proof. The DMV told them they had to have a smog test. If the car fails the smog test, am I at all liable? The money has exchanged hands and the title has been transferred. Can I be held accountable by the DMV for not providing proof of current Smog certification?
Answers:
Does anyone know how long I will be banned from driving? And how it affects my insurance?
Maybe the question should be asked, how much is this test? Will the vehicle that you sold pass the inspection? id you sell the vehicle as is, and indicate that on the bill of sale? This is not a requirement in my state but I have sold used cars and will tell you the few little words are as good as gold "As is," if this was not an accepted method to sell a vehicle then you could not sell the old junker that sits in the drive way even to a junk yard. When you give a deposit for car insurance do you get that money back?
That is a State Law.But, I think you can sell anything that was bought legally. What State? Look up yourstate.com/.gov then DMV or Automobiles.Do I need car insurance if my car is not used?
If you're a private party selling a vehicle to another private party, no, you're not liable. You're selling the vehicle "as is."Dealerships, on the other hand, have to acert that emissions and brakes are in order.
First, there is a basic premise in law that says "ignorance of the law is no defense (excuse)"
The only way you're off the hook is if you wrote "as is" clearly on the bill of sale. This condition of sale, even in a private sale, must be written and not merely understood by the parties.
However, if it is a State requirment for all vehicle sales to include an existing smog test certificate, maybe you have to negotiate with the new owner to get the certificate testing done.
Can you find out who owns a car?
the only way to get out of the smog is if you wrote on the bill of sale sold for "parts only".More Questions & Answers ...
