If I caused a car accident, and the guy I hit lies to my insurance company saying he was hurt. Will they pay?

My roommate had a small fender-bender while driving my car. She didn't file a police report because she wasn't sure what to do. A police officer did come out to the crash site, however, and the guy my roommate hit told him everyone was fine, and we would handle the situation on our own since the damage was slight. We told the guy to get a few estimates and we would pay to have his car fixed. Instead, he just wanted us to write him a $500 check. He said he was "helping us out" because he could have said something about being injured. When he said this, we decided to just give him insurance information, so we wouldn't have to deal with him. He filed it under my parents insurance, but when my dad talked with his agent he was told that his insurance would go up drastically because now this guy was claiming that he and the other three people with him were injured. My question is, will my insurance have to pay since we don't have a police report that proves that the guy is lying?

they will do an investigation, but if the guy goes to the hospital and gets a medical check and is hurt, your insurance will settle with him

if there's injury it'll be a police case & not private settlement with your insurance company i believe. in this case i believe its a private settlement and the dude can claim from your dad's insurance.

You first of all shouldn't have gotten your parents involved. That was just dumb. Second, you should have filed a police report, period. Third, if there WAS an officer on the scene, he should have the accident report that says that no one was hurt.

Last, because you didn't act to defend yourself from the get-go, this guy can probably say or do whatever he wants. Because you probably had a party to go to, you opted to be extremely lazy(and let your roommate drive your car which is a no-no), and now this guy has the upper hand. To be honest, you deserve whatever you get.

That is basically what an insurance adjuster will do. A claim is a claim.....whether it is $100 or $1000.00. I would leave it up to the company. People get dirty when they realize that they can make a few bucks.

Do your parents insure YOUR car? If so, I would suggest you do some growing-up. The insurance company is obligated to PROTECT you, (or your parents in this case), so they may be boxed into a situation where it would be more logical to pay some additional money to the scum-bag(s) vs fighting in court (where you would face possible exposure for lawsuits, etc.). However, the other people better not start packing for the Bahamas just yet. If they are injuried, (as opposed to being sore), they better be prepared to produce some med bills, x-rays, etc, etc. Insurance companies are not in the habit of rolling over and playing dead when it comes to their money. They have armies of lawyers ready and waiting for the sleezes that advertise on late night local TV that claim they can bring an insurance company to it's knees in court. Right. As far as rate increases, underwriting is handled differently in every company but it is rare that any would base increases to the relitive amount of the claim settlement. It is usually based on frequency, type of loss, conditions of accident, etc. As to your question 'why is this dirt-bag lying'? Everyone lies, some more than others. Stop freting and let the adjusters work it out -- and pay for your OWN policy for heavens sake!

The police report wouldn't matter anyway. Even if he had said at the scene that he was fine, he's not locked into that. People don't always feel the effects of certain injuries until 24 hrs or so later. Do I believe this guy was hurt? No, but the insurance company will require him to prove his claim in the form of medical records if he insists on making a claim for bodily injury. If he has records indicating he was hurt, there's nothing else they can do.

He is probably looking for the insurance to give him a few hundred bucks to go away, which they will if they can. He was trying to milk you from the beginning and probably wouldn't have taken your $ or would have come back for more if you'd tried to settle out of pocket anyway.
