Who is at fault in the 3 cars accident?

Question:
1st car was entering the ramp on a busy highway. 2nd car was about to be right behind her as she entered on the same lane without yielding. Then all of the sudden, she stopped right there on the busy hiway. I can tell by her brake light on right away and the 2nd car also stopped because of that and 2nd car hit 1st car. By the time I saw what has happened, I stepped on the brake and hit the 2nd car. 2nd car driver got out of the car and looked really upset at the 1st car on the front. That's when I knew that 1st car stopped in front of the 2nd car for no reason. There weren't any cars in front of the 1st car. This accident took place in Oct. 2004. I got the summon on August 2006. 1st car is suing more towards the 2nd car and to me a little bit. I don't have all the details why 1st car delayed for a couple of year with the lawsuit. Who is at fault? Police reported said that 1st car failed to yield and that the 2nd car hit her and I followed too close to the 2nd car.

Answers:

They said i'm lost in the system, what do i do now?

Because the first car field to yield, that initial action caused the accident. I don't think the person would be successful with the lawsuit. It's their word against the police report. Pkus, because there weren't any cars in the front makes the lawsuit frivolous.

Why are UK car licence plates white on the front and yellow on the back?

Your story was too long and too involved. Traffic laws are written for a 2 vehicle situation. When a third vehicle is involved, then the guilt shifts to the last vehicle with a clear chance to avoid the accident.

I was rear-ended and in a lot of pain, what are my rights?

Seems like it should be two separate accidents to me. The first one would be for V1 failing to yield right of way to V2. The second would be you for following too closely to V2. You need enough from between you and the car in front of you to be able to come to a complete stop without hitting them.

When is Geico going to offer auto insurance in Canada so I can switch?

sorry but u will probably get a following too closely even though some idiot hit brakes for no reason. given certain speed u should be behind car for certain distance, ie one car lenght per ten mph. that way, if car does come to stop, u have ample time to stop. i sympathize with you but court will not. if police report said first car failed to yield, then there had to be something to yield to. i am curious how yours and the second cars testimony of first car stopping for no reason will go over in court. keep us posted. good luck.

What is a good vehicle with a low insurance rate?

Who's the she? Fault varies by state. Obviously, the last guy in is at fault 100% for his portion of it. It's an entrance ramp.

If you are really rich do you need insurance?

The first guy isn't at fault for ANY of it.

My agricultural quad, is it road registered?

Depending on your state laws, the last guy in might be at fault for ALL THREE CARS, or, the damage for the first car might be split between car 2 and car 3. The front end damage of car #2 might ALSO be split between car 2 and car 3.

I have a question for floridians?

If you're the last guy in, you're screwed, basically. BOTH the other drivers can sue you and win.

Wallet taken while on vacation, how do I get a drivers licence?

Police do NOT determine fault. The police report does not determine fault. Fault is determined through case law and statutes.

Does anyone know the regulations for driving a Vespa?

Report this one to your insurance company right away. IF you don't have insurance, you're going to be writing checks.

Whose insurnace should I make a claim with? Car that rear-ended me or the car that rear ended him into me?

It's irrelevant why car #1 stopped. Car #2 and #3 were following too closely, or they would have been able to stop in time.

I misplaced the title to my car! What do I have to do to get a new one?

When you get into a car accident, it is usually the last car that's at fault. But based on the information you provided, you will still be a little bit at fault b/c on the police report it indicated that you were following too close. The 1st cars injuries are the proximate cause of the 2nd cars fault. You hit them after the accident occurred. If you were in a car accident, you would have to treat with Doctors to see if you are injured, your not just going to file a lawsuit. Since you had no knowledge that you were being sued until now, then I will have to assume that car 1 tried to settle their claim with car 2 and car 2 probably didn't come high enough or they denied the claim. If you had insurance at the time of the accident, then I wouldn't be too worried about it. You aren't personally being sued. And now in days, when car accidents go to trial, you must prove several elements to get compensated. And lately, noone has been getting compensated like that. So don't worry. Forward the summons over to the insurance company so that they can file an answer on your behalf. If they don't file an answer within 35 days from when you were served, then they can get a default judgment against you for whatever amount they want. So contact them asap.

Auto fender bender...my insurance company wont pay their claim, Am I liable?

FYI, police don't determine whose at fault, but they do put on the police report who should be at fault, and the reason. They are in codes.

What are the penalties for driving with fictitious tags?

Despite the fact that the first car caused the accident, the burden is on the following cars to stay far enough behind to avoid a collision, which means that you both have a part in the liability for the accident. If a car stops in front of you for any reason, then you have the obligation to stop or steer clear of it. I have been rear ended twice in the past few years because no one ever allows enough room to stop in case of an emergency. I did and ended up being rear ended by four cars the first time and recently by two. They both tried to state that I stopped too quickly. Well, the law is perfectly clear on that matter and they both lost their claims and had to pay my damages. The moral of the story is keep at least one car length for every 10 miles an hour, and pay attention what is going on around you and up in front of you when driving. Following too close, too fast, and driver inattention are the main causes of accidents on the freeways.

Is there any websites where you can find out a full detail of a car..?

It doesn't matter that the 1st car stopped for no reason or entered the highway without yielding. Cars 2 and 3 were too close. That's it.
The idea is that if a driver breaks the law (doesn't follow the rules of the road) this doesn't give other drivers the right to break the law.
Imagine you are backing out of a driveway into a street. You need to let cars in the street pass and then back out. Right? So you wait, see that the road is clear and start to back out. At this moment another car makes illegal U-turn from the opposite side of the street crossing a solid center line. You hit this car. You are at fault.
That other driver might get a ticket for illegal U-turn, but the fact that he did something illegal doesn't give you the right to hit him.
In your case, the driver of the 1st car might get a ticket for not yielding (if this can be proved) but cars 2 and 3 still at fault.

I bought a used car and now I find out the it isn't registered in my name! Anyone been thru this too?

You are definately partially at fault. NO getting around it. If you were maintaining proper distance from the second car you would have never rearended it causing it to rearend the first car for a second time.

I'm buying a car in Indiana but I am moving to New York in a couple weeks. Where do I get it registered?

This situation is tricky but let me give it a try: If in fact the 1st car stopped for no reason, he could bear a portion of responsibility for creating a hazard as well as not yeilding. Car 2 may have some responsibility for following too closely, it just depends on who a jury would believe and the location of damages to the vehicles(front to rear, lft front to rt rear)
Car 3 will have responsibility to Car 2 for following too closely and a portion of Car1 if Car3 caused damage additional to that caused by Car 2

I had a very small at-fault accident and told the owner I would pay for any repairs rather than submit to ins.

2nd car owes damage to 1st car, you owe rear end damage to 2nd car. They are 2 seperate accidents. You and 2nd car were following too close.

How can i find out a car owners identity, i have their license plate number?

First of all let me start things off with a joke from www.BlackJokes.com What do call white stuff around a black mans mouth?
Answer: Crack!

Do car insurance have to replace car parts with genuine brand parts when the other person was at fault?

Because black people cannot help themselves they like to steal bikes. They also love to sell drugs. Why are their lips so humongous? It looks like bees sting them on their lips all the time. I just want to beat blacks in the head with a baseball bat every time I seem them.
