I got into an accident the other day on the interstate.. I hit the guy from behind.. I don't think it was my fault since he cut me off.. but I think I am automatically at fault since I hit him... The police never came.. he took my information and said he would contact his insurance company.. Can he make a claim against me without a police report?

I am a licenced claim rep. Yes, anyone can file a claim, however, your insurance company has a legal obligation to investigate prior to making a payment. Just because you hit someone from behind does not automatically mean you are at fault. You say the other person cut you off...If you were traveling in heavy traffic with not much space between you and another vehicle and someone cuts in front of you not leaving you much room and traffic comes to a sudden stop, then the person who cut in front of you leaving you little room to stop would be at fault for making an unsafe lane change. Report the claim to your insurance company immediately and let them know what happened. Your insurance company is their to protect your interest and will only pay a claim to another party if there is irrefutable evidence that you were at fault. If your insurance company denies the other party, the other party's insurance company will pay the claim under the other parties own collision coverage and then they can file arbitration against your insurance company providing both insurance companies are members of intercompany arbitration. If the other pary does not carry collision coverage under their own insurance coverage then their only recourse is to file in Small Claims Court. If they file in Small Claims Court, your insurance company will hire an attorney to defend your claim.

yes he can. but having the police show up and establish that he cut you off would have been to your benefit. Now he can just say that it was your fault. So unless you have any witnesses. Don't admit fault and take it to court.
