Its all very well introducing the "3 points on license" if caught using a mobile handset but shouldn't the drivers who are not doing it have the power to report other drivers they observe using their handset. They could give the details (vehicle reg etc) to their local police station for them to investigate. They're not enough police on the road to monitor this.

I could not agree more. I observed, not for any particular reason, a number of parents dropping off their little ones at school, start driving and using their mobile phones.However, I was on a bus recently and when approaching a right turn, the bus driver answered a call on his mobile and turned the single deck bus with one hand. Did I report him? No but with hindsight, perhaps I should have done so in the interest of other passengers.

I suspect the problem would come when he denies it and says he'd stopped safely to use the phone. It'd be your word against his - unless, of course, you could provide photographic or video evidence.

If it bothers you this much you can get in car video systems for cars ( many driving instructors use them). If you had a rear facing camera you could catch the image of a driver behind & their registration number).Got a speeding ticket. Will my insurance go up?
This would provide sufficient evidence for the police to act if they were interested. (I think it would make you a bit sad though).
