Question:
A family member was in an accident with another car, rather than lose a safe driver discount, we are going to pay the other driver for the damages and not report the accident. I need to find a legally binding form for the other driver to sign that releases us from any liability for the accident. We are worried that the other driver will deny that we ever payed. We live in Oregon; that may affect what form we need.
Answers:
Car insurance claims when not insured!?
Look up "Full & Final Release and Discharge" on the web. Modify the form to fit the accident. Make sure it contains a waiver of any Oregon statute that reserves unknown claims (in California it is CC1542. I'm sure Oregon has something similar.) On the check that you give for payment write on the back above where it will be endorsed "Negotiation of this check constitutes a waiver of all claims for injury, loss or damage to person or property, present or future, known or unknown re vehicle accident of (insert date.)"What car insurance company's in Ireland will quote someone with 2 endorsments on their licence ???
