I went to the parking lot and the car didn't stop when I stepped on the brake because of the black ice. My kids were yelling at me and I turned my head to tell them be quiet. I stepped again on the brake pedal, but my foot split off and hit the accelerator pedal causing the accident. I didn't deliberately step on the gas pedal. I have tried very hard to learn English when accident happened, I became shocked and thrilled, I may not express myself correctly. Do you think it is good for me to have a court day and persuade judge that I am not guilty? I hope that the judge might ask me to take driving violation course to take off two points. I don't want the points to raise up my insurance fee.

Since you didn't say where you are located, I assume the USA. In my state, California, if you just pay the ticket, it's the same as pleading guilty, and it goes on your driving record. 2 points sounds kind of high, like maybe you got a ticket for more than a minor violation. You didn't say what you were cited for. For instance: unsafe speed? If you got a ticket for a minor moving violation, you can go to traffic school here without having to go to court and ask the judge for it. If you got a ticket for negligent driving, I don't think you could go to traffic school, it depends on the laws where you got the ticket. I don't know whether you can have a court trial and be found not guilty because I don't know the circumstances, or what you will say in court, besides, if you already paid the ticket, then you've already said you did it by paying the ticket, so your case is already decided. At least that's how it works in California. Go to your local traffic court and ask them for information. Don't be afraid of the clerks behind the counter, they are there to help you, not to get you in trouble. If you don't get help from a clerk, ask for a supervisor to help you. As to your insurance cost, it will go up just because of the accident; depending on how you handle any damages to your car and I assume another car, since you didn't say. If it's just minor damages, many times it's cheaper to just pay for damages and not involve your insurance company, so that they don't know about your accident. Do you have a Legal Aid Society in your area? They could help you better because they could get all the details from you and they would know the laws in your area.

You did not say what the fine was for, but you should go to court and take someone who speaks good english with you, it can't hurt to try.

Even though it wasn't done deliberately, it is still your fault, unfortunately. Did you file a police report? What was their opinion? This is what insurance companies go by, what the police report says. It was an accident and that is why it is called that. It is an event that you cannot predict and control. If this is your first offense with your insurance company, and it didn't cost them a lot of money to pay to the other driver, don't worry about getting your fee raised. It might not happen. It would cost more to fight it and you will likely lose the case, anyway.
