A woman drove into the side of my car hitting me on the nearside wing and door (my car was two weeks old)we where on a car park wich was classed as a road for insurance perposes by the police she drove at about 30 miles per hour into the side my wife was taken to hospital with minor injuries the impact to my side pushed my 5 feet side way's with my brakes full on as far as I am concerned and the solicitor. she never even braked she used my car as a break I have taken photos and had a map of the car park it has all been altered since the accident and looks completely diferent now in this day and age you would think this would be straight forward failling to stop and driving without due car and attention (not so she say's I did not anticipate her driving into me and it was my fault for being in her way.I am still waiting to go to court that will be in July sometime that will be 23 months after the accident who is to blame me or the other driver.I would love to read your answers.

it wasn't your job to try and avoid her and her driving,if it had not had been you there it would have been someone else,so it wasn't your fault,i don't think you,ll have to worry too much when this does go to court,from the way you described this, it sounds like it was her fault,and i don't think the court will rule in her favor either,not on one that happened such as this one did,good luck,i hope this help,s.Will a speeding ticket in AZ show up on my CA record?
If you were stationary on the car park and had been still for a long time before she hit you, then it is HER fault.If you reversed or pulled out in front of her while she was travelling along the road, then it is YOUR fault.

First off.. two years in the US to bring a case to trial is not unusual with all the discovery and declarations required. As for the fault. Based on YOUR input (she obviously has a different viewpoint)
a) Her speed is excessive
b) No one ever drives based on what they think the other person thinks that she thinks she might do. (I mean get real)
c) If she moved your car 5' sideways from a dead stop you can get a good value of her speed to substantiate that (pure physics).

1) SOunds like the injuries were minor and all have healed.. thats the good part
2) Eventually it will all be resolved.
