I recently had this very thing happen I was rear ended and pushed into the car in front of me. My insurance found the driver who hit me at fault for both my car and the car in front of me.you would claim off the person who hit you, then the person that you hit would claim off of you. can get very messy with those situations,your best bet would be not to admit responsibility,and let the insurance companys sort it out.

I think that it would all depend on how fast they were going. If they were going so fast that it pushed you real far into it. I was always told that you are always suppose to be at least a car length to a half a car length when you stop or drive behind someone. If you don't which most people don't and you are already so close to them and you were hit from behind then you were responsible. I might be wrong but that is what I was told. You know if the insurance can work it's ways they will always try to blame it on someone else through all their little loopholes that they won't be responsible.its always the car at rear who is at fault. about 2 years ago a woman smashed into the back of me while i was waiting to turn right when the police arrived she tried to get out of it by saying i was not indicating (lying) the copper said it was irrelevant anyway and said no matter what she was in the wrong. she got pretty stroppy but her insurance paid out immediatley.
