Insured but lapsed mot. How will it affect claim?

Question:
I had a minor bump the other day (wing mirror to wing mirror - my fault). While my car just lost the mirror the other car's mirror went through the other party's driver's window. We both changed addresses and left with the other party getting a quote for repair. Since getting home I found my MOT had expired (totally unwittingly) by 6 days. His quote has now come back at over £1000 so rather than settling with a cheque I will be going through insurance for his car. It seems incredible that my car lost an £80 mirror with no other damage and his has sustained over £1000 worth but there you go. Will the insurance company be able to find out my car had a lapsed MOT if I don't declare it? and how will it affect the claim if at all? The only vehicle that will be claimed upon will be his, I am paying to repair mine and am re newing the MOT tomorrow when I have the new mirror fitted. I am comprehensively insured with protected no claims bonus.

You'll probably be fine. I wouldn't mention it and hope they don't find out. I doubt it would make all that much difference anyway. The worst they could possibly do is deny the claim, in which case you are no worse off than if you paid the guy yourself.
