When you get the police report, call the insurance company & see if a claim has been filed. If one hasn't been filed, file one.You can use the p/r to give them info they'll ask for on the other driver.
depends a lot on where you are. Are you in a no fault state? Or perhaps a state with a law on the books that makes any accident the fault of the person driving without insurance? If neither of those apply to you, just find out what it will cost to get your car fixed and then contact the person who hit you and ask for that amount, unless it's way more than your car is worth. In that case ask for the retail value of your car. They will probably contact their insurance and their insurance might contact you. Work with them when they do. Good luck.
There is no state that places total fault on the person who doesn't have insurance. You may get fined for not having insurance, but it has no bearing on who was responsible for the accident.
