so the idiot hit my car, by law its his fault because he was coming out of the intersection.
to make it worse, he managed to get away without giving us his insurance policy number. we did however manage to get his drivers license and address.
later that night he calls us up, says he filed a police report and told us he was waiting for us to pay for his car. (im sorry, you may not be able to speak english properly but in this country, YOU FIX OUR CAR!)

now the problem is i dont think he is fixing his car through insurance, so we wont be contacted by them. we dont have a way of getting him to pay for our damages, even though we have a witness (and damn straight he knows it!)

If you were involved in an accident, any accident, but especially if it is not your fault, you call your agent and report it, giving him all the information you have about the other driver. Then your insurance opens a claim, and takes care of you by getting the information about the other drivers insurance policy, and the two of them settle things for you on your behalf. Did you do that? If not, do so. If you did, call your agent and ask for an update.did u call the police when accident happened? if not get wittness then make report he probably dosnt habe insurance
sue him ... or better still go to cops saying you have a witness ..... and if none of tht wrks ..... beat the hell outta his car . :-)

If you have insurance, I think you make a claim for it and they try to collect the money from the other person. But as it isn't your fault it, your insurance company should pay for your damages and do all the work.Making a police report is important - soon after the accident is best.
