Question:
Hi there! i had a accident with another car, I was driving on a single carriageway road,Passed the bend on the left, Saw a car completetly on my side of lane, more towards the kerb, As i tried to avoid him, i steared to go to otherside(right side) When i approached on the middle of the road, the other car also turned towards me, i applied the brakes but i don't remember what happened next, The passenger who was with me got out and then came back in to rescue me, Our vehicle toppled over. Later we were admitted to the hospital and i was told the other driver has died. The only witness i have is my passenger. After couple of months the inquest took place, I couldn't beleive the police report was not right it was in favour of the deceased person, The police did not blame who's fault it was, From their calculation they think he was on his side of the road, The police are not charging me. What do you think i can do next. I have fully comp insurance
Answers:
However if a third party puts in a claim then it will be up to your insurance company to deal with the claim
If you decide to claim for your losses and injuries then you will need to approach a specialist solicitor who will in all likely hood contact some one like me to investigate the incident to see if you have grounds for a claim, this may require you to answer further questions and you may need to make a new statement of the facts regarding your version of events, If you have a witness then that will be taken into account along with the various reports generated by this type of incident
Sorry to go on but that is the outline of the options available to you
my car overheatted !! will my full coverage insurance policy cover the towing?
The first thing to do is set the record straight regarding whose fault it was. If you haven't already done so, draw an aerial diagram of the scene before, during and after the accident and submit it to both insurance companies and the police. INSIST (in writing) that your version of events is true and accurate.Once the record is set straight and the accident is deemed to be 100% not your fault, get your insurance company to reinstate your no-claims bonus, then proceed with an injury claim if you genuinely deserve and need the compensation.
I got wheel clamped the other day in Whitby?
You won't be surprised to hear this will all take a *very* long time - well over a year, I expect, probably more as there is a fatality involved.
Getting my mother's truck on the road??
For a personal injury claim to succeed there usually has to be evidence of tort ( a wrong doing ) to cause injury to the claimant,if there has been an inquest and there has been no charge then it sounds like an open verdict was concluded, you could contact an injury solicitor who should be able to advise you on any outcome of a claim. Are you afraid of being attacked by a saber tooth tiger?
If the only witness there is is for you, then it would seem that you would win in court. If you do not like the police report, write a letter to the police explaining why they have errors to the report and ask that your letter be included in their file of this incident.how long does a dr10 ban stay on driving licsense?
this is a strange one. point of impact he might have been on his side of the road even though you had to swerve to avoid a crash that fact you are not being charged your not being blamed for the crash or his death should go in your favour you say you are fully comp then the insurance comp should pay out for car and personal injury good luck. When you're driving do you feel like you're in control of the car?
