Heres the story... one of my semi trucks was involved in an accident. It was not my drivers fault. Accident was in Michigan. Found out MI is a "no fault" state and ins co only had to pay $500. Had to get the rest for repairs and such from my ins co. They paid for repairs but for lost revune messed me over. I lost $8,944 due to truck being down. My ins co only paid $1375 because of their "policy". Can I go back and sue the woman that hit my truck? Or would it be a waste of time considering Michigan law is "No Fault State". Lady was cited and we have a witness.

I haven't handled claims in MI for a few years but I believe under their MINI-TORT statute you can only collect the $500 or your deductible whichever is smaller. I don't think there is a provision for collecting loss of revenue.Hopefully, somebody who handles MI claims will come along and give you a definitive answer.

Id say go for it and sue her. Chances are they find her guilty and make her pay pretty much everything. Of course there is a chance they may not make her pay anything. But a "no fault state" doesnt mean shes not at fault. The only bad side is it would prolly be done in small claims court and if they do make her pay you could wind up waiting years to collect on it. The courts arent to strict on enforcing payment through small claims. I sued someone in small claims 3 years ago and won. and im still waiting for the money. So good luck.More Questions & Answers ...
