The insurance company is saying that I was not covered because the "time" the policy was signed was after the time of the accident. According to the DMV I was covered the day of the accident as of 12:01 a.m. The "proof of insurance" card did not indicate the policy taking effect at a different time. CA. law states policies are effective/cancelled as of 12:01a.m. on any given day unless otherwise indicated. So, should I fight the insurance company? My car was totaled and the policy would only cover $3500. under the uninsured motorist portion of the policy. The bluebook on the vehicle is $12,000. The unlicensed uninsured individual got a slap on the hand, a small fine, from the DMV.
Any help would be appreciated.

Heck yes fight them, and take the uninsured idiot to court as well. Sue him/her to make them pay for the damage to your car. That's what they get for being unlicensed AND uninsured. Even if the uninsured person is dirt poor, the judge can order their wages to be "garnished" each week/month to pay for the damages to your car. Don't let the scumbag get away with it.Why is there an additional surcharge added for West Virginia car insurance?

I'm sorry your in this tough situation. I'm not sure if it would even be worth it money wise to fight it in court since your maximum payout would only be 3500. You can try to obtain the document from the DMV that states your insurance is effective since 12:01 am of the day the policy is signed.Why are there so many freaks at the DMV?
Your other option is to sue the driver. That may also be a waste of money considering if he doesn't have a license or insurance, most likely he doesn't have any money either. Good luck
