You will get lots of ill informed answers to this question I am sure, but I will help you as much as I can. I worked for the police in the U.K. and dealt with this sort of thing on a daily basis. Basically the insurance will still be valid if you can prove to the insurance company that your car was roadworthy on the day of the accident. Not having a current m.o.t. will NOT invalidate your insurance. The insurance company may want proof that the car was roadworthy, i.e. service records from garage, photographs of vehicle if possible. You need to explain to the insurance company that not having a current m.o.t. was an oversight on your behalf and that it was not intentional.As for not having a valid m.o.t. with regards the police. At worst you will get a summons (with a pre-determined court date) i.e. you don't have to attend court in person. There will be a section on the back of the summons where you can plead guilty (you can add any mitigating circumstances also). You would just need to return this document and the case would be heard in your absence. The magistrates' will determine the fine (court costs are addes as well) NO penalty points will be added to the licence as not having an m.o.t. does not incur penalty points.
The better scenario would be that you just get a written caution from the police - no fine, just basically a slap on the wrists. PLEASE, PLEASE do not let anyone inform you that by not having an m.o.t. will invalidate your insurance, it is just not true. If I can help in any way, please feel free to email me.

I don't understand why somebody got on their high horse because they used to work for the police. It has nothing to do with the police. If your insurance company has it written in to your policy that it will be void without a current MOT certificate, then your insurance will be void. Its as simple as that. There is no universal rules, insurance companies can and will attempt to get out of paying at every opportunity. The only way you are going to be able to tell is contact your insurer to find out if it is a condition on your policy.
