anyways i was at a complete stop i seen no cars from either side so i went when out of no where this car hits me and says it was my fault the only damage to my car was the front headlight but his car was badly damaged he was going at least 65 mph on a 35mph street he then told me speeding or not he had the right of way i then told him lets call the cops to file a police report he was scared and said u fix ur car and i fix mine and we call it even i said okay fine well i just got a letter in the mail saying after investigation i am to blame but i never spoke to anyone what do i do now??

As others have said ALWAYS call the cops. Let me suggest the following.
1. If you have insurance call them NOW if you haven't already. I assume the letter you received is from the other guys company. Give that letter to you insurance company.
2. Photograph your car damages. Also, it's also a good idea to keep a disposable camera in your car. To take photos of the cars at the scene, It is also a good idea to take photos of the debris field and any areas where fluid leaked out of the cars.

3. Speed is very hard to prove although it can be done via an accident reconstruction but that is very expensive. If it can be proven that the other guy was speeding he forfeits his right of way.
4. If you do not have insurance you are not going to be able to prove that he was speeding and you will be found to be at fault if the case went to small claims court. Best case for you if you don't have insurance is do try to settle the claim with the other company. Most will take monthly payments. I would suggest offering to pay 60% of the other guys damages, because whether he was speeding or not he will have comparative negligence.

You get yourself a damn good lawyer. Unfortunately, you screwed yourself when you agreed to this guy's plan of you paying for your car and him paying for his. This is EXACTLY why the LAW tells you to file a police report when involved in an accident, regardless of whether it's a dent or the entire thing is totaled. sue him. or atleast tell the cops wut happenedit seems like the guy went to the cops after and said "his side" of the story, then u got the letter. He is wrong. If he was speeding, then the accident was his fault. He was breaking the law. You were not.

Well I hate to say, but you should of called the cops anyway. The guy was apparently trying to get out of something, or he was on drugs or something like that and didn't want to involve the police. Contact an attorney and see what he says. But this may be a lost cause for you. Sorry..

My guess is that the guy will screw u over big time. he'll demand money saying he had the right away. bla bla bla... ur insurence will have to pay for damages to his care, they will then preceed to cancel u.. The police will give u a few tickets: failure to report an accident, leaving the seen of a crime crap like that. he'll get the same but i think since his car had the damage u will get the majority of the blame...so all in all u have learned a very valuable less on... it blows big time dont it. id say that was the guys plan all along.

well...this may be a little far-fetched, but if the person who was speeding has a warrent out for his arrest, then he wouldn't want you to call to cops b/c he didnt want to get arrested. as for the letter you got, he might have investigated the scene to see if he could get any money if he sued you.OR
i just thought...he might have known that he was at fault for the crash, so he didnt want to call the cops (then he wouldnt have to pay for your car). then he investigated the cash and sent you a letter saying that it WAS your fault...maybe he wants to sue you? thryin to make a quick buck
