one person was backing up, another pulling in a parking lot,the one pulling inthe the parking lot hits the other in the rear while he is backing out. the one calls police an accident report was filled out,no tickets were issued, police leaves a few days later woman calls says she has two estimnates who is reponsisble for the scratch

It has nothing to do with being on private property, and everything to do with the fact both cars were moving. Parking lot accidents are almost always 50/50. I never move in a parking lot when another car is moving nearby. If I get hit, I definitely want it to be somebody else's fault.

No tickets were issued because the accident happened on private property - the parking lot. I would let the insurance companies duke it out, because it sounds like you were both at fault. The one backing out for not looking close enough and the one pulling in for not waiting and failing to avoid an accident. The insurance companies assign a percentage of blame and the appropriate insurance only pays for that percentage only.

Ifthe police report does not indicate fault, parking lots are typically "no man's land". The owner of the scratched car will likely have to pay out of pocket or have his insurance pay for it- if he's covered for it.....unless he can persuade the other driver to admit fault, or at least give their insuraqnce info, for the 2 companies to hash out. If it's a minor scratch you'd do well justto polish it out, so your rates don't go up- plus you've probably got a $200 DEDUCTABLE ANYWAY.
