Question:
Last week my parked car was hit by a moving car. The police report just got published and I filed a claim. I got a couple estimates and the damages will cost around $1500. Is there a way I can get the money from the accident and not get my car fixed? All the cars involved have insurance. I can live with a little dent and a few scratches.

Yep, people do it all the time. Just give your estimate to your insurance company and they will cut you the check.Yes, as long as it was 100% the other drivers fault. I bought a car for £700, clown clips my back wing while I'm parked waiting for my kid to come out of school, insurance co. says it cost £800 to fix so writes off the car, I kept driving it for years and pocket the £800 perfectly legally, all you need is a clown and a witness.

It depends on the state or provincial laws. In Manitoba, you get a claim form, and the body shop gets paid directly. If you do not owe money on the car you can do whatever you want with the money. If you owe money on it you'll have to have it repaired. If you don't owe money on the car you do not have to have the vehicle repaired. They should pay you the amount of the estimate minus any sales tax. Just remember that if you have another accident they are going to deduct this amount from any future claims.
