You go to the courthouse to the tag and title section. Have the V.I.N. # for the car with you and tell them you want to file for a lost title for that car. You must know the person's name the last title was titled to. Take application home and sign the name to it and take it back a couple days later. Another way, so long as you know the name of the last owner, tell them the person is bed ridden and they will give you a form to take to get it signed. Sign it and take it back a few days later.

You did not mention the state, and different states have different rules and regulations. If the original owner signed over the title to you, and you lost it, you just have to go to your local DMV office, prove ownership like a registration in your name and file for a duplicate. However if the original owner did not sign the car over to you before he/she died, then you have a problem since you are not the titled owner. At that point you will probably need a death certificate, power of attorney or a surrogate certificate or maybe a will to get a title for the vehicle. Check with your local DMV to find out what you will need. Probably the person that is managing the estate or executor or family member will be needed to transfer the ownership to you.
