(unless the other guy is drunk, then unless the cop is a retard which has happened to me) It is all about who had the right of way. What were you backing out from? How hard did they hit you? If its a driveway..it shouldnt be that bad. If it is, were they driving safely? wreckless?If I understand this you were moving backwards and the othercar was moving forwards. If either of you was stopped, I would say that the other was at fault. If you were driving down the street backwards, I would say that it is the same as if you were driving forwards on the wrong side of the street . You are at fault . If you were backing out of an angled parking spot and hit a passing car, you are at fault.
