Are you saying it was his fault or has it been ruled that way by the insurance companies/police? Whose insurance is paying if it is hers they may ask for it but if it is really the other guys fault they should be able to recover it from his insurance if he has any. If it is clearly not her fault you should be able to waive it but if it is a gray area you may want to consider backing off. If your insurance company decides to withdrawal paying how much will that cost her? Lawyer fees, paying for the repair up front until the matter is resolved all cost money. If the repair bill is considerably more than the deductible and there is no clear ruling of fault by the insurance companies/police then you might want to pick another battle.Good luck

if the vehicle was totaled, she should get the value of the car minus the deductable, that's what it would be from her insurance. That's how insurance works.she won't have to pay anything out of pocket, she should just get what the car is worth from the other guys insurance.

Are you in a no fault state? Did the at fault driver have no insurance? If the answer to either of those questions is "Yes" then probably your insurance is footing the bill for repairs, and you would have to pay the deductible. If they ever collect what they are out, they will pay you back, or you can take the at fault driver to court to get your out of pocket exprenses back if you'd like.
Any time you make a claim thru your own insurance company you will have to pay the deductible. If your sisters company feels that she is not at fault for the accident they will subrogate against the other persons company. That just means that they will ask for the money that they paid out along with your sisters deductible. When they get it back, they will send her a check.
It doesn't make any difference who is at fault for the accident, if you make a claim against your own company you are ALWAYS going to have to pay the deductible.
