I BACKED INTO A GIRL AT WORK IN THE PARKING LOT. WE EXCHANGED #'S BUT NOT INSURANCE I THEN ASKED HER IF SHE WANTED TO GO THROUGH OUR INSURANCE AND SHE SAID THIS COULD BE RESOLVED WITHOUT GOING THROUGH THEM. I TOLD HER TO GIVE ME AN ESTIMATE OF THE DAMAGES AND ILL PAY SHE AGREED. SHE GAVE ME 1 ESTIMATE AND I JUST WENT AHEAD AND GAVE IT TO HER CASH. I HAVE THE RECIEPT SHE SIGNED STATING THAT I PAID HER IN FULL FOR DAMAGES. NOW SHE WANTS ME TO PAY FOR HER A RENTAL WHILE CAR IS IN THE SHOP. THATS WHY I ASKED HER IF SHE WANTED TO GO THROUGH INSURANCE. SHE STILL TOOK THE MONEY TO GET HER CAR FIXED THOUGH. I TOLD HER I WOULD PAY FOR DAMAGES INSURANCE WILL NOT COVER ANYTHING NOW IT HAPPENED A WEEK AND A 1/2 AGO AM I WRONG?

Your first mistake was not exchanging insurance, which probably meant she doesn't have insurance. Second mistake was not getting an agreement in writing. Third mistake was paying her in cash receipt or not, but at least you have the receipt. Since insurance would pay for a rental you should probably pay for the rental but get it in writing that she has to pay for rental car insurance, but you will pay for the rental car. Otherwise if she doesn't get insurance on the car you'll be paying for damages to the rental car if there is another accident. Most most most most important thing for you to do is get it in writing and possibly notarized. Best of luck.

If she agreed to you paying damages and you paid damages, you don't have to pay for a rental, unless you just have a good heart and want to do this. If she wanted these extras she should have went through your insurance company. You said you have a paid in full reciept, that's all you need.

Well for one thing if you would have reported it to your insurance your rates may not have even went up because the damage to her veh was less than a 1000 dollars... But as far as paying outta pocket there is no law against it, I wouldn't recommend it. Because the person can always come back claiming bodily injury, and more veh damage.. But as far as the rental goes, hell no don't pay for it.. U have proof that you paid her in full, and that is that.. Tell her to go to a shop that gives free loaner veh's. Most city's, states have a couple body shops that give free loaners, and most will honor the estimate she got from the other shop, especially if they want the work.. If she continues to push for it, then speak w/ your agent, and see if there is anyway to file a claim.. Or tell her to give the money back, and you will file with the insurance company...

Since you have a receipt that she signed saying you paid her in full for the damage, she has no way of collecting anything else from you. Tell her to get lost.

You only paid for the DAMAGES. The at fault party owes for damages and well as a reasonable amount of rental to get repairs done.
