Question:
Hypothetical question. A big wreck takes place in an intersection in your town. The wrecker service neglects to sweep up all the debris caused by the wreck. You drive through the wreck site – having little chance not to because of the flow of traffic – and your tire is punctured by some of the debris. You got the tire store and have your flat fixed. Who pays? Is it the person who caused the wreck? His / Her insurance co? The wrecker service for not having completed the job? Or the city for not insuring the debris was cleaned up? Think about it. Who pays for the damage to the car(s) that were involved in the wreck? Should that same party not be responsible for all the damages they cause? Including your tire?

You'd have to prove that piece of debris was from the wreck and that it wasn't there before or after the wreck.More Questions & Answers ...
