Is it legal for a car supplier to sell a brand new car the register it in there name the day i pick it up?

I bought a brand new car 3 months ago and have not yet recieved the log book. When i asked the garage about the log. They said it has not yet been returned to them. Now i have since found out that i will be the second owner were does the law stand. As far as im concerned it is a second hand car im i right or wrong
