Long story short. I recently split up w/my fiancee. He's in jail for 3rd offense DWI and of course, lost his driver's license indefinately. He talked me into putting one of his trucks in my name, because the state of Michigan won't let him register a vehicle in his name. (I never got plates or insurance on it) He's now driving the truck around when he's out of jail on work release with the plates he had on it. I signed and dated the title when I gave it back to him, but I don't know if I can get in trouble if he got in an accident with it. Could I be held liable if someone got hurt or killed? What if he told the cops I gave him permission to drive the truck? I have two kids to think about here. I can't afford any fines or possible imprisonment if he does something stupid. Help please?

Even if you signed and dated the title. It is an "Open Title" Meaning that until someone else that has a DL signs the title and gets plates for it, you are responsible for what ever happens to or with that vehicle. You are in a spot my dear. I would contact the local DMV and make sure. But in my state that is the law. If he get boozed up and kills someone you are in a world of hurt. You need to contact the DMV and possible contact your local Law enforcement..Call an insurance company, a lawyer, or even the police. One of them should be able to advise you on this matter.

I am not sure since you have not ever registered the vehicle, if he has the title showing that you signed it and have not register it yet then I think that you could, but if doesn't have proof of the title being signed then the state will still show the truck registered to him. I am unsure of michigan law however its very possible you could be charged with fraud by getting the registration put in your name. You did mention that you signed the title back over to him, but I bet he did not re register the vehicle under the updated title. and the fact that he is driving on the original plates that is under his name. the plate and the registration will not match, plus he is knowingly driving w/o a license. So I think the prosecutors would have a field day with him if he gets busted. But I wouldn't be too worried about it you offense would probably just get you probation if you got anything at all.i would definitly call the dmv and get it out of your name, there is a form you can fill out but, i forgot what it is called. you can probably do it online.

This could be very serious for you if he causes a serious accident. Try and transfer the ownership back to him. He cannot register a vehicle but he can own one. Is he is using your registration for himself? If so you need to unregister this vehicle immediately. Contact your local DMV for additional help.

in michigan the law states that if the title is in your name and your allow a non licenced driver to drive your auto then you ARE responcable weather or not you know he has a licence or not if its your car its your responceablty so think about that but most of the time the auto will be inpounded and youll have to pay about 400 to 500 to get it back out and as far as fraud no you licenced the auto for your self as far as anyone else knows your the only one driving i guess just plead the fifth is your best answerEven if you signed the title over to him, the vehicle is still yours until he takes the paperwork to the DMV and registers it in his name. That means if he gets parking tickets or if it gets towed, your responsible. As far as accidents are concerned, I doubt you could get dragged into a lawsuit but you never know.
There are people saying that it's not your vehicle because you signed the title over.. THIS IS NOT TRUE. I sold a car and the guy never put it in his name. Car got towed and salvage yard wanted me to pay storage fees. Cops said it was still my car since the other guy never registered it. I let the salvage yard keep the car to waive the fees.
