I got hit on my motorcycle yesterday by a guy in a rental. The cop said we had to call the rental place ourselves to get the guy's insurance info. My husband called today and they said they're not sure if the guy has insurance. They said he didn't get the rental's insurance, and he signed a waiver saying he does have his own ins. They said since he signed the waiver they didn't need to see his proof. That doesn't sound right to me! By the way, everyone is fine (except my bike). I did manage to keep my bike up though, that's a very good thing!

your current insurance may cover you in a rental if not the rental co.can rent u insurance also!The rental company does not, in general, verify that the driver has insurance. If someone waives the insurance, then that person is responsible for paying all and any claims. Even if the rental company (or YOU, in this case) has to take 'em to court.

From your perspective, your insurance company is responsible for fulfilling your claim. If they wish to go after the other guy, they can do so. You don't need to get involved.

Regardless if he signed the waiver- the rental car company is supposed to ask for his proof of insurance. ESPECIALLY if he is signing the waiver not to purchase their rental insurance- they should want to make sure that he is somewhat covered if/when he gets in an accident... by the way- you always want to purchase their insurance- even if you have your own, because your personal automobile policy WILL NEVER cover everything that you are signing for... if you wreck a rental and total it- they are also going to charge you for loss of use for not being able to rent that vehicle out anymore and make money on it- that is NOT covered under your personal auto insurance. In your case- it sounds like the rental company screwed up here when they didn't ask to see his proof of insurance after he signed and waived purchasing their coverage---- if worse comes to worse, I would sue the rental car company.Court Summons for not having all documents?
The rental company is responsible to make sure their vehicles are insured . No matter what was signed it is up to them to make sure of that. If they are not willing to provide you with that information then I would contact the main office if it's a large national chain ...Also it is up to the police officer to make sure that both parties carry insurance or ha should have laid charges .. regardless of the amount of damage driving with out insurance is a crime in most states..
I would consult a lawyer on this one ... because i think your getting the run around here.. you could also go to the police dept and talk to a supervisor because that officer should have had that information in his report ..
Some places also go by the amount of damage done before they file reports or charges but never the less you should have gotten something in writing .. contact your insurance company provide them with what ever information you can and let them handle it .. I hope you have this drivers name and address ..
