Please look at the above link re: an uninsured accident that happened 5 yrs ago that I am accused of. I've just been informed that a Statutory Demand is a precursor to making me bankrupt.
Has anyone ever dealt with Statefarm insurrance, for a claim against one of there insurred who...?
The 1st letter I have had in relation to this was this am - the debt collectors had apparently written to an address I've not lived at for 6 yrs. Can they make me bankrupt over something I've not done? Can't speak to the MIB as they sold the debt on.
I've spoken to 1 solictor who says they've not heard of a motor offence going this far and I am scared witless. Has anyone got any good advice/contacts?
Just to reiterate, the person who had an accident gave my name & old address,had a car the same make/colour of the car I had garaged. I have never driven whilst uninsured. I dont know the £'s involved until the notice is served next week

Think I'd make the police station your 1st port of call. Sounds very much like a fraud case..

Go to the police today - this is someone using your details - not an uncommon fraud in use to be honest.However, the onus is on the other party to prove it was you - which I doubt in this case, that they can.

The other thing which is strange involves the registration number - why didn't the claimant get the number and use that - that would prove one way or another that it wasn't you - if the number plate was cloned then it is not down to you anyway - it is up to the claimant to prove the fact - not you.

As for not being able to speak to the MIB - that is crap - they may have sold the debt on but they do have the authority and an obligation to investigate properly the claim you are making - they should re-check their paperwork.
All you need is one witness to say your car was off the road and if poss a repair bill to back it up -

PS Having seen your addendum, that's dreadful service from a solicitor - clearly couldn't be bothered! I'd trawl through Yellow Pages & make some calls, you're bound to find someone who IS interested.

Just look at your previous question you said that the car was in the garage when the accident happened, did you pay by cash, cheque or card if you paid by the later 2 then you have all the proof that you need that the car was in the garage when this happened, is there anyway that you kept the receipt or did the garage fill out your service logbook with dates that is was with them. A debt collector can only pursue in this way if he has the relevent documentation from a high court.you are intitled to request in writting the the "debt" be put on hold for a period of time to carry our further investigation. employ a solicitor and provide them with a copy of the letter.

the debt company are however obliged to give you the details of the insurance company chasing or have sold the debt so you can gather proof.

so suggested plan of action:
1) contact the debt collector and ask for a copy of all the relevent paperwork relating to your case. inform them verbally that you intend to apeal against this debt and on what grounds. inform them you are employing a solicitor to work on your behalf and give them their details. ask if the have a high court judgement served against you.

3) put your objection in writting to the debt collector and photocopy any proof that you have that the car was off of the road. send a copy of this to your solicitor.

4)once you have all the details from the debt company (namley the insurance company details) pass this on to your solicitor asap.

You can provide proof of your whereabouts on that day, were you at work during the time frame? Where the accident occurred, are there cameras set up, so that you could review the tapes for that day? It's very odd that someone would use your information, you don't know who it may be?
Do you have irrefuteable proof you were not the one involved in this accident? If you have, take all your paperwork to the police and report it as sounds like someone is using your details. I would also get a credit reference check done as well, to see if there is any other details that you don't know about being documented. There is the point however, that the someone who was involved in this accident and gave the details, must know you very well to give all the details plus be driving the same make model & colour of car?? Are you sure the car was not being used without your knowledge while in the garage?
