I put down $1000 on a vehicle that the dealership ordered but was not there yet. They told me in would be there in 4 wks. 4 wks later I find out it will be another four weeks. (8wks total) Can I get my money back if I back out? I technically didn't order the car from scratch is was already on the way. I just put money down to reserve it.

I would say it depends upon what the agreement that you signed when handing them the $1000 says. If you put money down with the understanding that it was to be delivered within 4 weeks, then they have not fullfilled their end of the agreement and it is now a voidable contract. I'm willing to bet a big ol' fat sum of money though that they were careful enough to not put anything in writing stating that they agreed to deliver within 4 weeks. If not stated in writing, you're probably going to be fighting an uphill battle. It's just their word against yours as in most verbal agreements. However, if you do have something in writing, then they are clearly in breach of the agreement and MUST refund the money, despite any claims they give you that all deposits are non-refundable. They have failed to complete their end of the contract and as such are obligated by law to return your money.

If you have trouble getting your money back, I would let them know how you intend to get your lawyer involved, as well as the Attorney General for your area.. and a .22 guage. Don't even waste your breath mentioning the BBB as they've probably already got a ruined rap sheet with them since they're scum.

If no, and you paid the deposit by check, you could try to put a stop payment if they haven't run it through already (some keep them and don't run them through until delivery).

I drove the brand new SUV for 4 weeks, and after all was said and done,the dealership told me that my finance charge would be substantially higher than we agreed on. I brought the vehicle back and demanded my $2500 down payment back. I received every penny. You are the customer, and not satisfied, definitely demand your money back.
