I was locking up and said to my two collegues to wait in the car as i needed to use the rest room first. while in the bathroom i heard a crash and came running out to find one of them behind the wheel, the generator knocked over and my car backed up agains the cement fencing. this was three months ago and i was promised that the damages would be fixed. i still have not heard or seen anything and i continuously call and there's always excuses. i need my car an recieved fines for driving it as is. I need to get some compensation for the damages not to mention the inconvenience and the extra expenses this has caused. what do i do.

It's time to get your lawyer to work on this issue. Has your colleague given you any type of quote or is this a (Oh I can fix it) issue. contact your lawyer and let him know what went on. have him make contact and only him from this point on. if they still refuse at least you have legal documentation of attempting to correct the problem through proper means. If they sick their lawyer on you let the two Bull it out. A settlement will happen sooner or later. What happened is essentially that someone "stole" your car and wrecked it. Auto insurance would consider this a comp claim which would also require that a police report be filed.

When things like that happen you should always get a signed promisary note at the scene of the incident. Make sure you have pictures of the damage and take the person(s) responsible to small claims court. Always make sure you get things in writing because when you get to court the judge doesn't know if the person really said they would pay for the damages unless they admit it.
