You say it was while the paperwork was in progress? If that's the case, you do not have to pay the impound fees, your paperwork that was submitted to change the title/registration will be dated when it was received and the status of the transaction now. If you mean, the guy that bought it hasn't started the process, well, yep, you will have to pay because the car is still legally owned by you, until the name is changed on the title, it is still yours. An impounded vehicle can only be released to the owner of record, and apparently that's you. You can then return it to the purchaser when he pays you back for getting it out. If you don't want it out, no problem, give the tow company the title and the storage will then stop.

When you sell a car you MUST fill out a release of liabity with the DMV to let them know that you no longer own the car and who is responsible for it.
