What role does an attorney play in an auto accident in which all the parties are covered by insurance?

Question:
My wife was involved in a multi-vehicle accident started by another driver in which four cars were totaled and some people were injured. It appears that everyone is covered by insurance. If insurance is covering the situation, why would one of the drivers retain an attorney to sue the other drivers?

Answers:

Can you have a car insured under someone other than the loanee? How?

They're not suing, they're just representing the person involved and presenting the claim. The attorney is the only person with whom the claim can be discussed on behalf of that person. He gathers all the medical documentation, presents it to the insurance company, negotiates and settles the claim, gets the check, takes 1/3 of it, pays the rest to the doctors and his client and then he's done. If there is a suit he does more, but it doesn't sound like it's in litigation.

What insurance companies have you had trouble with auto and home?

Not all insurance is created equal meaning some people might have better coverage than others (state minimum). And insurance companies want to spend the minimum possible to cover the claim (of course). So an attorney is retained so that the innocent party involved gets the maximum amount they can for their damages (both personal and property).

do you have to buy auto insurance before you buy a car?

Insurance companies as a rule try to get out of paying whenever possible. It might be that one or more of the companies said they weren't going to pay (saying the fault was someone other than their client's fault). The other person may be trying to get the money from the people in the accident rather than go after the insurance company itself.

Question about insurance and car loans?

I'm not sure that I wouldn't try going after the person rather than the company, since the company has more money and more experienced lawyers (since they get all that practice) while the person may not know what is available to them to fight me back. In essence, the other person with the lawyer probably has a better chance of winning against you and the other two drivers then against the insurance company.

Auto Insurance: What is "Release of All Claims" form?

Some people want to get rich quick, and there are plenty of lawyers out there that will help them because they get rich too. People are too quick to sue these days.

Police lost my car, what do I do??

If all the insurance companies don't agree on placing blame, or if one person feels they are getting shorted, an attorney can be hired to represent that person in a court to establish blame, and amount of loss. When that happens it will usually slow things down drastically for all the other parties.

Some idiot with no license hit the passengers side of my car.?

Because people are getting more and more greedy. If everything is taken care of, and no one is critically injured, let the lawyers chase another ambulance somewhere else.
