i have a 99 honda civic it wont go into gear when the car is on but it will if the car is off why?

Worn out is not the term you should use. There are no moving parts (unless you include electrons). Parts of the ECM may stop functioning ie. injector drivers, solenoid drivers, etc. but mostly this caused by something else overloading a circuit. If an old ECM works then use it. Once installed, it can be scanned for function.
