Can Pathfinder pass emission test with noisy 1st, 2nd and 5Th gear, but sometimes not noisy or does it matter?

Has great power,as usual, and sometimes not noisy
Clutch was replace 10 months ago by a mechanic who said the job was hard (could he have messed up?) Sound like rocks and mostly when cold

As long as the emissions tech can operate the vehicle SAFELY for the duration of the inspection, noise doesn't matter. The transmission must operate smoothly, along with the clutch (if your state's emissions test is performed on a dyno)
The ONLY thing of interest to the tech, as far as the inspection is concerned is…
1) Visual; is all of the required emissions equipment in place, and un-modified.
2) Does all of the emissions equipment function correctly and according to the manufacturer's design (Ignition timing, fuel cap, "Check Engine" light, EGR valve, idle speed, etc.)
3) Emissions; are the tailpipe emissions within required standards.
If your little SUVIE will pass the above standards, it will pass the inspection!

It sounds like you may have a bad pilot bearing or throw out bearing! Have a qualified mechanic check it out, that is not that hard a vehicle to replace the clutch!!

The transmission has nothing to do witgh emissions......... Emissions are the carbon monoxide levels emitted from the engine when running...as in how clean the exaust air is. Noise pollution is not detected by them.

No it does not matter. and it sounds like rocks, the tranny is going bad.Probably not the clutch installers fault.
