Does the oil overflow tube on a 4 stroke dirtbike suck up oil?

I keep getting water in my oil it is just when i go through mud or a creek or something where the only thing in the water is the overflow tube.

It should not. Generally the oil will blow out the tube. It depends how deep you are going. If your going so deep that its over the intake of the tube on top then you will get water in it. Look for another source. Bad seal on oil cap, sucking it in through a vacuum leak. Or is it liquid cooled and it's filling with coolant.
