I have a 2000 dodge dakota pickup with v6 engine and auto trans, the transmission doesnt want to shift out of?

Question:
1st or 2nd gear until i have driven it for a few miles, also it wont shift out of 1st or 2nd at all when the fuel level gets around an 8th of a tank...??? Anybody know what is causing this?

but it works ok with a full gas tank? did u check tranny fluid? whats the fluid smell like...burnt or dark brown/blk means new/ rebuilt tranny time.. get it checked might b something easy, longer u wait the worse it gets..trust me...
