Well, for this offense, I doubt jail time is likely( but not impossible). You will probably be fined, all depends on the area of the country you live in. If all you want to do is increase performance, remove the cat, gut the insides, and put it back on. At least it's still ON the car. The law doesn't say they'll inspect it INSIDE, and you can claim ignorance, if you bought the car used. You can also keep the cat intact, and remove the muffler to improve performance, as the noise is muffled coming thru the cat anyway, and isn't excessively loud ( usually ) with just a catalytic converter on the car. I don't think it's illegal to remove a muffler, but getting it thru a safety inspection might not be possible( darn Gov't interference) You can also buy legal , high-flowing cats to increase performance ( preferred legal route ), or for that matter, add 1 or 2 more used cats to increase the flow rate, and still help the environment. No one will likely add a used cat to your car, not sure if parts yards will sell you one, either, so that's iffy at best.no, but you can get a hefty ticket and it will make your car run like crap
