My friend was in a car accident.?

Question:
A friend of mine was just in a car accident. everyone including the driver of the car she hit, is fine. What had happen was she had came into a one way road of a parkinglot and hit the other drivers car making it unable to drive. My friend doesnt have her license, and the other driver had called the police when the police got there he said that my friend was lucky that the accedent was on private property because if had been any where esle she would have been going to jail. He also said that the person she hit could go after her civally.
I guess my question is what could the other driver sue my friend for? Wouldn't she be happy with the insurence money? my friend is really sacared. What is the worst or the least worst thing that could happen?

First she didn't have a license. So she's completely at fault. The other driver doesn't have to file an insurance claim for the car, she can sue to make your friend pay for all damages to the vehicle, anything that is still due the bank on the vehicle, lost wages, medical bills, etc.

There's more, but it really doesn't matter. Your friend, will learn a very hard lesson in breaking the law if the person or the insurance company sues her. She's basically hosed financially either way. And if a judge wants to make an example of her, she could be in for tens if not hundreds of thousands of dollars.

If she hit me, the first thing that would be going through my mind is GETTING PAID! Mainly because if she isn't old enough to have a license, her parents are then responsible financially. And I'm sure her parents have money, insurance, or both.

First, no license therefore no insurance. So the other driver can not "be happy with the insurance money" because she is not going to get any insurance money. Insurance companies do not pay when an underage or otherwise illegal driver is operating the car.

Second, hitting another car in a parking lot so hard it can not be driven. Just how fast was your friend driving in that parking lot? Most lots are 5 mph. The other driver can take her car down to an appraiser and get a "speed estimate" as to how fast your friend was driving based upon the damage done.

Third, your friend might be able to get the person not to sue if she agrees to pay for all damages to her car. If the other driver agrees to that, she needs to get it in writing that the other driver agrees and will not seek any further damages.

Fourth, your friend needs to smarten up! If that accident had happened on a public street, she would be sitting in a jail cell and being charged with driving without a license.
